Ugandan opponents of the harsh new Anti-Homosexuality Act are hoping for an immediate victory tomorrow in their Constitutional Court challenge to the legitimacy of the law.
The court is expected to rule tomorrow on whether parliament acted  unlawfully last December when Speaker Rebecca Kadaga called for a vote on the bill when a quorum was lacking.
If the court agrees with that argument, the law is likely to be struck down. If the court disagrees, it will proceed to consider whether the law violates the Ugandan constitution.
The law provides for imprisonment for five to seven years for anyone convicted of “promoting homosexuality” or who “in any way abets homosexuality and related practices.”  (See more provisions of the law in the article "Draconian details of Uganda’s misguided new anti-gay law.")
The current challenge was brought by LGBT and human rights activists, legal experts and opposition politicians.

If the court agrees that Parliament broke procedural rules, plaintiffs' attorney Nicholas Opiyo told BuzzFeed, “it appears … it will dispose of the entire case,” and “it looks likely” that it will decide that tomorrow (Thursday).
The following report on today's proceedings was prepared by Adrian Jjuko, executive director of the Human Rights Awareness and Promotion Forum -- Uganda (HRAPF), who chairs the legal committee of the gay-friendly Civil Society Coalition on Human Rights and Constitutional Law.
Today, the Constitutional Court of Uganda heard the Petition against the Anti Homosexuality Act as planned.
Five of the Petitioners were in court: Prof. J Oloka-Onyango, Hon. Fox Odoi, Frank Mugisha, Jacqueline Kasha Nabagesera and HRAPF. They were represented by five counsel: Ladislaus Rwakafuuzi, Caleb Alaka, Francis Onyango, Nicholas Opiyo and Fridah Mutesi. The Attorney General was represented by Principal State Attorney (PSA), Ms. Patricia Mutesi.

Five Justices of the Constitutional Court [were present]: Hon. Justice S.B.K Kavuma, Hon. Justice A.S Nshimye, Hon. Justice Mwanguhya, Hon. Justice R Opio Aweri, and Hon. Lady Justice Solomy Balungi Bbossa.
The case started with the lead Counsel for the Petitioners, Mr. Rwakafuuzi introducing the legal team and the case for the petitioners, and informing court that the petitioners were ready to proceed.
The PSA raised an objection that the state was not ready to proceed since they had been granted up to 10th September to finalise preparations on the matter. She submitted that they intended to file supplementary affidavits. She wanted the heaing to be restricted to the applications for an interim injunction.
The Justices adjourned court for 20 minutes to deliberate on this. They returned with a ruling that since the state has not filed any application to file affidavits out of time, there was no basis for the PSA's assertion. They ruled that the hearing of the Petition should go on.
The PSA then asked court to stay the hearing since they intended to appeal the ruling. The Court heard arguments on both sides and once again decided to proceed with the hearing. Court asked Counsel for the Petitioners to submit on Issue no. 1.
Counsel for the petitioners submitted on Issue No. 1 which is on quorum arguing that the Constitution requires the Parliament to have quorum as laid down in the Rules of Procedure before they can pass a bill into law. The Rules of Procedure require the Chairperson (Speaker) to ascertain quorum when the issue is raised. That this was not done in this case, and this makes the procedure through which the Bill was passed unconstitutional.
After submissions, Court adjourned the case for tomorrow July 31st at 9.30am.

[JURIST] US Representative Scott Perry (R-PA) [official website] on Monday introduced a bill [press release] to nationally legalize cannabidiol (CBD) oil, or marijuana extract, which has been shown to treat seizures in children suffering from epilepsy. Although the bill, called the "Charlotte's Web Medical Hemp Act of 2014," does not legalize all forms of marijuana [Penn Live report] for medical use, it does remove CBD oil and therapeutic hemp from the federal definition of marijuana in the Controlled Substances Act. "Therapeutic hemp" is that which contains no more than .3% THC and thus produces no "high." The introduction of the legislation coincides with a promise [MSNBC report] by Pennsylvania Governor Tom Corbett [official website] to create a state level pilot program for families whose children require access to medical marijuana. Marijuana and its extracts are currently banned for both medical and recreational purposes at the federal level and in a majority of states, including Pennsylvania. Charlotte Figi, a young girl in Colorado whose story sparked a national movement, went from having 300 grand mal seizures a week to having only two or three as a result of treatment with CBD oil. Though the legislation does not mark a change in Perry's stance on the legalization of recreational marijuana, the Congressman stated that children suffering from seizures deserved a chance to lead a healthy and productive life, and that the government should not stand in the way.
The use of marijuana for medical [JURIST backgrounder] purposes has garnered more legal support [Marijuana Policy Project website] in the US in recent months. Last week Illinois Governor Pat Quinn [official website] signed legislation [JURIST report] that will allow adults and children suffering from seizures access to medical marijuana, amending the Compassionate Use of Medical Cannabis Act to allow children with parental consent to access medical marijuana. Quinn signed medical marijuana legislation [JURIST report] last year. The Compassionate Use of Medical Cannabis Act is one of the country's strictest medical marijuana laws, requiring users of the drug to carry an identification card, enroll in a confidential multi-agency verification system run by the Department of Health, and obtain a written certification from a physician regarding the specific needs for marijuana and the expected outcomes. Earlier this month New York Governor Andrew Cuomo [official website] signed [JURIST report] the Compassionate Care Act [text] into law, making New York the twenty-third state to legalize medical marijuana. Last month Florida Governor Rick Scott [official website] signed [JURIST report] a bill allowing a non-euphoric strain of marijuana to be used for the treatment of epilepsy, cancer and amyotrophic lateral sclerosis (ALS). Minnesota lawmakers in May approved a bill [JURIST report] legalizing medical marijuana in pill or liquid form for a limited number of patients who suffer from severe or fatal illnesses.

That's what the kid behind the counter at Taco Bell said to me. 
I dug into my pocket and pulled out some lint and two dimes and something that used to be a Jolly Rancher. 
Having already handed the kid a five-spot, I started to head back out to the truck to grab some change when the kid with the Elmo hairdo said the hardest thing anyone has ever said to me. 
He said, "It's OK. I'll just give you the senior citizen discount."

I turned to see
who he was talking to and then heard the sound of change hitting the counter in front of me. 
"Only $4.68" he said cheerfully.

I stood there stupefied.
I am 56, not even 60 yet? 
A mere child! Senior citizen?

I took my burrito and walked out to the truck wondering what was wrong with Elmo.
 
Was he blind? 
As I sat in the truck, my blood began to
boil. 
Old? Me?

I'll show him, I thought.
 
I opened the door and headed back inside. I strode to the counter, and there he was waiting with a smile.

Before I could say a word, he held up something and jingled it in front of me,
 like I could be that easily distracted! 
What am I now? 
A toddler?

"Dude! Can't get too far without your car keys, eh?"
 
I stared with utter disdain at the keys. 
I began to rationalize in my mind!

"Leaving keys behind hardly makes a man elderly!
 It could happen to anyone!"

I turned and headed back to the truck.
 
I slipped the key into the ignition, but it wouldn't turn. What now? 
I checked my keys and tried another. 
Still nothing.

That's when I noticed the
purple beads hanging from my rear view mirror.I had no purple beads hanging from my rear view mirror.

Then, a few other objects came into focus:
 
The car seat in the back seat. 
Happy Meal toys spread all over the floorboard. 
A partially eaten dough nut on the dashboard.

Faster than you can say
ginkgo biloba, I flew out of the alien vehicle.

Moments later I was speeding out of the parking lot, relieved to finally be leaving this nightmarish stop in my life.
 
That is when I felt it, deep in the bowels of my stomach: hunger! 
My stomach growled and churned, and I reached to grab my burrito, only it was nowhere to be found.

I swung the truck around, gathered my courage,
 and strode back into the restaurant one final time. 
There Elmo stood, draped in youth and black nail polish. 
All I could think was,

"What is the world coming to?"


All I could say was,
"Did I leave my food and drink in here"?

I took the food and drink from the little boy and sheepishly apologized.

All of this is to explain how I got a ticket doing 85 in a 40 mph zone.
 
Yessss, I was racing some punk kid in a Toyota Prius. 
And no, I told the officer, I'm
not too old to be driving this fast.

As I walked in the front door, my wife met me halfway down the hall.
 
I handed her a bag of cold food and a
$300 speeding ticket. 
I promptly sat in my rocking chair and covered up my legs with a
blankey.

The good news was that I had successfully found my way home.

Casey Stegall, a gay man who worked as a caretaker at the Children's Home of Lubbock in Lubbock, Texas was fired after he introduced some of teenage clients to his male fiance' during an outing at a water park on July 4th.
When Lynn Harms, president of the organization, heard about it she accused Stegall of engaging in inappropriate public displays of affection. "As a faith-based, church-related outreach providing welfare services, if you will, to children and families, there is a set of biblical values that we adhere to and live by," Harms told The Lubbock Avalanche-Journal "When you are implementing life training and so forth -- particularly with children -- to put a confused message out there is counterproductive."
Stegall who along with his boyfriend are both devout Christians had a spotless employment record and was often praised for his work, but was fired on the spot, without any opportunity to defend himself against the charges. Harms also compared being gay to being sexually promiscuous, or acting ungodly or aggressive.
Stegall took great offense at this comparison and threatened to sue, and is now searching for a lawyer to take a case against the Christian charity, but is stymied by the fact that the group is funded by the state of Texas, which has no protections for LGBT employees
"I want my case out there so that people know that this is happening to people like me."
The current version of ENDA that currently sits in the House of Representatives and which is backed by HRC would offer NO PROTECTION to workers like Stegall due to its extremely broard religious exemption that would allow "faith based" organizations to discriminate legally against LGBT workers.

Family Research Council hate group president Tony Perkins is going absolutely apeshit over the fact that his hometown of Baton Rouge, Louisiana is in the midst of debating a a local law banning discrimination of LGBT people in areas of housing, employment and public accommodations.  Perkins is so mad that he publicly slammed the city saying that by considering the Fairness Ordinance that it send a message that "Christians and conservative businesses that they are not welcomed in Louisiana's Capital City."  (Drama Queen)

"The degrading comments of a city councilman aligned with the Baton Rouge Area Chamber and other prominent businesses in my hometown are sending a message to Christians and conservative businesses that they are not welcomed in Louisiana's Capital City. In attempting to pass a special rights measure based upon sexual behavior last Wednesday, Councilman John Delgado ironically lashed out at opponents in his closing remarks alleging that their opposition to the controversial ordinance was using the council to impose a 'Christian version of Sharia law on the citizens of Baton Rouge.'  The comments came after three and half hours of public comment on the so-called 'Fairness Ordinance', a measure similar to the one recently adopted by the Houston, Texas council and now the focus of a citizen-led referendum to overturn it. The 'Fairness Ordinance' would create a new cause of action in District Court for allegations of discrimination on the basis of various categories, including sexual orientation and gender identity, something the Louisiana Constitution explicitly prohibits. While not surprised at how the advocates of these measures slander the opposition, it is alarming that the Baton Rouge Area Chamber would want to be a part of sending a such a religiously-discriminatory message that only certain citizens are welcome to participate in the democratic process."
