The Council of State has ruled that the dismissal of a teacher who has
homosexual relations in their private life to be against the law. The
Council of State has pointed to the lack of evidence, indication or
witnesses to show that the plaintiff reflected homosexual tendencies in
the school or engaged in such relations with students outside of the
school. It also pointed to the testimonies of teachers and directors
taken during the disciplinary investigation who work in the same school
as the plaintiff in which they state that they have not seen any
negative acts and that they have not heard anything about the issue.
