Judge declines to suspend Houston same-sex benefits policy

federal judge has denied a request to halt a new policy that allows
same-sex spouses of Houston city employees to apply for benefits. The
ruling did not address the constitutionality of the policy, but set a
hearing date for late February to determine where the case will be
heard. "The tide has already turned," said Kenneth Upton, an attorney
for Lambda Legal. "I think it's all just playing out now in a
predictable way."
